Petitioner seeks bail in anticipation of his arrest in connection with Jandaha P.S. Case No. 27 of 2019 registered for the offences punishable under Sections 302, 420, 406 and 120B of the Indian Penal Code.

On the basis of complaint case FIR has been registered and it said that petitioner and others have taken the son of the complaint/informant and later on his dead body was found kept lying in N.M.C.H.

Submission of learned counsel for the petitioner is that as a matter of fact son of the informant fell down from the bus and he was taken to hospital where he died an an U.D. case has been filed by son of the informant and after six months the

present case has been lodged and considering the same coaccused has been granted anticipatory bail by this Court by order dated 3.7.2019 passed in Cr.Misc.No. 41064 of 2019 (Annexure-2).

Heard learned APP, who also could not controvert the fact that there is general and omnibus allegation against the petitioner.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 27 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
