2 14-11-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Dumra P.S. Case no. 214 of 2019, registered under Sections 147, 149, 341, 323, 324, 307, 379, 504 and 448 of the Indian Penal Code.

The accusation is that government land situated adjacent to the house of informant is in his possession on which his pattidar Dukha Ray (Petitioner No.1) along with his family members tried to take possession. Thereafter, informant made protest then five persons named in the F.I.R., including the petitioners, with intention to kill started to cause assault through lathi in which informant Bishnu Ray fell down

sustaining injury on his head and became unconscious. At that time petitioner No.3 Chuliya Devi and petitioner No.4 Nilam Devi entered in his house and took away his suitcase containing 20,000/- and ornaments.

Learned counsel for the petitioners submits that informant and petitioners are pattidar and occurrence of Marpit took place due to land dispute, but with ulterior motive, the informant filed the present case. Moreover, in medical examination no visible injury was found, except, body ache. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 214 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
