out of Phulawarisharif (Janipur) P.S. Case No. 667 of 2019, disclosing offences under Sections 341, 504 of the Indian Penal Code and Section 25(1-b)a, 26, 37(b) of the Arms Act.

Allegation against the petitioner is that he entered inside the house of the informant and threatened him on the point of pistol, thereafter, his pistol was snatched and the petitioner was caught, however, petitioner anyhow managed to flee away. The said pistol was produced before the police.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case at the instance of the informant, as nothing has been recovered by the police from the petitioner.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Judicial Magistrate -IXth, Patna, in connection with Phulawarisharif (Janipur) P.S. Case No. 667 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
