Salaiya P.S. Case No. 35 of 2018, registered for offences punishable under Sections 386, 387/34 of the Indian Penal Code, Section 4/5 of E.S. Act and section 25(1-B), A, 26, 35 of the Arms Act.

Prosecution case is that on suspicion police arrested on Ramjee Bhuiyan and in his confessional statement, he disclosed the name of petitioner and others and huge quantity of explosives have been recovered from Chalho forest. Apart from petitioner is accused in eleven other cases and all the cases are under C.L.A. act and other sections.

It has been submitted on behalf of the petitioner that in this case save and except confessional statement of the coaccused, there is absolutely nothing against him and now charge

has also been framed. It has further been submitted that the coaccused, who disclosed the name of petitoner, has already been enlarged on bail by a coordinate Bench of this Court vide order dated 20.06.2019 passed in Cr. Misc. No. 37392 of 2019. However, the above order does not show that the accused in that case was also having criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail. However, learned Trial Court is directed to expedite the Trial and conclude the same as early as possible.

This application is, accordingly, dismissed.
