Heard learned counsel for the petitioner and the

learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Risiyap P.S. Case no. 70 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

The accusation is that in course of checking of the vehicle one tempo was seen coming, when signal was given to stop the tempo, the driver of the tempo started fleeing leaving the tempo, but, on chase, he was apprehended, who disclosed his name Niranjan Kumar Singh. On search, 98 pouches, each containing 200 ML country made liquor recovered from tempo kept in sack.

Learned counsel for the petitioner submits that,

admittedly, the petitioner is the owner of the tempo bearing registration No. BR26K-4258 and the same was being driven by co-accused Niranjan Kumar Singh on rent and this petitioner has no knowledge about carrying of liquor on the tempo of the petitioner. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-VIIcum-Special Judge (Excise), Aurangabad in connection with Risiyap P.S. Case No. 70 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
