The petitioner seeks bail in connection with Balliya P.S. Case No. 233 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, in short, is that 174.750 liters wine is recovered.
It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in jail custody since 25.06.2019. Charge sheet in this case has already been submitted. It is alleged that 174.50 liters wine is recovered. There is no compliance of Section 100

Cr.P.C. Learned counsel for the petitioner further submits that similarly situated co-accused, namely, Geeta Devi has been granted bail on 30.08.2019 passed in Cr. Misc. No.54708 of 2019.
In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 2nd cum Special Judge, Excise Act, Begusara in connection with Balliya P.S. Case No. 233 of 2019.
