The petitioner seeks pre-arrest bail in connection with Barhara P.S. Case No. 160 of 2019 registered under Sections 341, 323, 504, 379, 308 and 34 of the Indian Penal Code.

The accusation is that three persons, named in the first information report, including the petitioner, came at the door of the informant, Bhikhari Yadav, and started to abuse. When the informant made protest than this petitioner gave lathi blow causing injury on the lip of the informant. However, Shiv Kumari Devi, wife, Soni Devi, daughter, and Punam Devi, daughter-in-law of the informant, rushed to save the informant, then, this petitioner also caused injury through lathi at the head of Shiv Kumari Devi. Shree Yadav caused injury to Soni Devi, daughter of the informant and Rakesh Yadav caused injury to Punak Devi, daughter-in-law of the informant. Submission is that injuries, as found on the persons of the informant, his wife and daughter-in-law, are all of simple in nature. In fact, occurrence of marpeet took place due to dispute in which petitioner’s side also sustained injury, regarding which Barhara P.S. Case No. 161 of 2019 was instituted on the basis of the fardbeyan of Shree Yadav on 09.05.2019 against the informant and others.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Barhara P.S. Case No. 160 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
