Petitioner is in custody in connection with Kishanganj P.S. Case No. 258 of 2019 for the offence under sections 379 of the Indian Penal Code.

Learned counsel for the petitioner would submit that allegation against this petitioner is that he was involved in theft of motorcycle of the informant. He submits that motorcycle was not recovered from the conscious possession of the petitioner. The real culprit has left the motorcycle and flew away and this innocent petitioner has been taken into custody.

Learned counsel for the petitioner submits that petitioner is in custody since 9.7.2019.

Case No. 258 of 2019 subject to the condition that bailors should be family members of the petitioner.
