Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Muffasil PS case no. 288 of 2018 registered for the offences punishable under Sections 354 (B), 379 and other sections of Indian Penal Code.

The allegation is regarding the accused persons including the petitioners herein having entered into the house of the informant, whereafter they had resorted to firing and had also misbehaved with the niece of the informant.

The learned counsel for the petitioners has submitted that a bare perusal of the injury report would show that all the injuries, if any, are simple in nature, which have been inflicted on the

persons of the informant and his family members. It is further submitted that though the petitioners are accused in one other case but they are on bail in the said case. Lastly, it is submitted that the present case arises out of case and counter case and upon assault made by the prosecution party, the brother of the petitioners has been grievously injured.

Having regard to the facts and circumstance of the case, I deem it fit and appropriate to admit the petitioners to the privilege of anticipatory bail. Accordingly, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Munger in connection with Mufassil PS case no. 288 of 2018 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
