This is an application for grant of anticipatory bail in connection with Barauli PS case no. 197 of 2019 registered for the offences punishable under Sections 379 and other sections of Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein, having had an altercation with the informant, whereafter they are said to have assaulted the informant and her daughter-in-law and snatched her golden chain. As far as co-accused Safi Ahmad is concerned, he is said to have inflicted sword blow on the daughter of the informant, however the petitioner has no complicity in the incident and there is general and omnibus allegation levelled against the

petitioner.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated and a bare perusal of the F.I.R. would show that no specific allegation of any sort of overt act has been levelled against the petitioner. The petitioner is said to be having a clean antecedent.

Having regard to the facts and circumstance of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIV, Gopalganj in connection with Barauli PS case no. 197 of 2009 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
