Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Prosecution case in short is that on 17.05.2019 the deceased/brother of informant went to attend marriage ceremony at Sahebganj (Nepal), where he taken wine, thereafter, barat party assaulted him. It has been stated that while the deceased arrived at Katihar he became serious, and on 21.05.2019 he died in way to hospital and the deceased narrated the name of two persons before the informant, 1. Dipak Kr. Paswan and 2. Prakash Thakur.

Learned counsel for the petitioner submits that the petitioner is an innocent and has committed no offence and he has been falsely implicated in this case on mere suspicion. The deceased was habituated drunker since long and he taken wine in marriage ceremony, where no occurrence of assault was taken place. There is no specific allegation against the sole petitioner. The petitioner has no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar, District-Katihar in connection with Katihar Town P.S. Case No. 325 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
