Supplementary affidavit is filed on behalf of the petitioner. The same be kept on record.
In the light of statement made in the supplementary affidavit, counsel for the petitioner is permitted to make necessary correction in paragraph-3 of the main application in course of the day.
Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 354B, 386, 504 and 506 of the Indian Penal Code.
The prosecution case, in short, is that the accused persons conspiring each other, entered house of the informant and caught hair of informant’s wife. It is also alleged that the

accused persons assaulted the wife of the informant.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-05-2019. Charge sheet in this case has already been submitted. The injury is said to be on non-vital part of the body. No offence u/s 307 of the Indian Penal Code is made out. At best, an offence under section 325 of the Indian Penal Code is made out. It has further been submitted that the petitioner may be released after completion of five months in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of five months in custody , the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 169 of 2019.
