Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Gopalpur P.S. Case No. 36/2018, instituted for offence under Section(s) 379 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that petitioners are not named in the written report. There is no recovery of any incriminating article from possession of these petitioners. No T.I.P. has been held in this case. Petitioners were made accused in Gopalpur P.S. Case No. 146/2018. Thereafter police has remanded these petitioners in this case merely on suspicion.

Petitioners are in custody since 20.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2^nd Additional Chief Judicial Magistrate, Gopalganj in connection with Gopalpur P.S. Case No. 36/2018 , subject to the conditions that both the bailors shall be the close relative of the petitioners.
