5 30-01-2019 Heard learned counsel for the petitioner, the State and the informant.

Petitioner seeks regular bail in a case registered for offences under sections 147, 148, 149, 302, 341, 323, 324, 326, 307 & 506 of the Indian Penal Code and under section 27 of the Arms Act.

Prayer for petitioner’s bail was earlier rejected on 26.4.2018. It is submitted on behalf of the petitioner that the petitioner is in custody since 8.1.2018 and other co-accused Meghnath Singh against whom similar allegation of causing injury by sharp cutting weapon was attributed, has already been allowed bail in the instant case.

Considering the aforesaid submissions and the facts and circumstances of the case, prayer for bail to the petitioner is

allowed. Let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Upahara Police Station Case No. 26 of 2017 on the following conditions:-

One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he/she is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and

The Petitioner will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.

Apprehension is raised on behalf of the informant regarding petitioner abusing or misusing the bail upon release.

If such occasion arises, needless to say, it will be open for the informant to take steps accordingly.
