Heard learned counsel for the parties.

The petitioner is apprehending his arrest in connection with Mahua P.S.Case No.220 of 2010 dated 5.6.2010for offences punishable under Section 392 of the Indian Penal Code.

Allegation against the petitioner is of lotting the articles, cash and the mobile and the name of the petitioner transpired on confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that except confessional statement, there is absolutely nothing against him and he has no criminal antecedent.

Having heard both sides, in this case a report was called

for as the case is of the year, 2010 as to whether the processes under Sections 82 and 83 of the Cr.P.C. have been issued or not but the report shows that the processes under Sections 82 and 83 of the Cr.P.C. has been issued and further a report regarding the criminal antecedent has also been received from the S.H.O. who has reported that there is no case against the petitioner.

In view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali in connection with Mahua P.S.Case No.220 of 2010, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
