Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Gardanibagh P. S. Case No. 1045 of 2006 instituted for the offence under Section(s) 25(1-b)a, 26(1) of the Arms Act.

The petitioner is in custody since 11.2.2019.

¶14

This is a case of misuse of privilege of bail. This is a case registered for the offence under Sections 25(1-b)a, 26(1) of the Arms Act.. The Sessions Judge has not mentioned in the impugned order about the date on which the petitioner was declared absconder.

Report called for from the Court below has been received, from which, it appears that bail bond of the petitioner was cancelled on 26.11.2010 because no pairvee was made on his behalf. Petitioner was declared absconder on 5.5.2014. The petitioner has been remanded in this case on the basis of the permanent warrant issued against him on 11.2.2019 and since then he is in custody.

This court finds that petitioner has sufficiently been punished for the latches on his part.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1^st Class, Patna, in connection with Gardanibagh P. S. Case No. 1045 of 2006 subject to the following conditions:-

(i) Both the bailors shall be the close relative of the petitioner.

(ii) The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.

(iii) If petitioner tamper with the evidence in the case,

prosecution will be at liberty to move for cancellation of bail bond of the petitioner.
