Submission of learned counsel for the petitioner is that he has gone outside for earning his livelihood and handed over the case to Advocate clerk and he has left pairvi and due to that his bail bond has been cancelled and non-bailable warrant has been issued on 10.3.2016 and petitioner has been arrested on 10.10.2018 and since then he is in custody. Further submission is that charge has been framed in this case but not a single

witness has been examined.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-VII, Bhagalpur, in connection with S.T. Case No. 1042 of 2006, arising out of Nathnagar P.S.Case No. 78 of 1997, subject to the condition that one of the bailors of the petitioner shall be a close relative of the petitioner having sufficient immoveable property within the jurisdiction of the court concerned and further he has to appear in court as and when required, otherwise his bail bond shall be cancelled.
