The petitioner is apprehending his arrest in connection with Runnisaidpur P.S.Case No.102 of 2017 , registered for offences punishable under Sections 30(C )(D), 32(I) of the Indian Penal Code.

Allegation against the petitioner is about recovery of 120 ltrs. of raw materials from the bamboo clumps of the petitioner and others.

Submission of the learned counsel for the petitioner is that the bamboo clumps is not of the petitioner, he has no criminal antecedent, he has been falsely implicated in this case and the seizure list shows that the recovery is from the bamboo clumps of the co-accused Ramchandra Sah.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II cum Special Judge Excise Act, Sitamarhi in connection with Runnisaidpur P.S.Case no.102 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
