Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Minapur P.S. Case No. 32 of 2019 for the offences under Sections 363, 365 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 21.01.2019.

Referring to the statement of the victim under section 164 Cr.P.C. he submits that the petitioner has no hand in the commission of crime. He further submits that the certified copy of the statement has not been provided and as such he is unable to bring certified copy of the statement.

antecedent and he is remained in custody since 22.01.2019, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 32 of 2019 with the condition that the Court below will verify whether the victim has mentioned about the involvement of the petitioner in the commission of crime. In the event victim has not mentioned about the involvement of the petitioner, the Court below shall release the petitioner on bail.
