out of Siswan P.S. Case No. 18/2015, disclosing offences under Sections 406 and 420 of the Indian Penal Code.

Prosecution case is that widening of the road was going on and petitioner was entrusted with the contract to cut the trees beside the road but he cut down as many as 377 trees, causing great revenue loss to the Government and he also did not sell the wood as fire wood and after checking of transportation permit, it was found that the partial permission has been done of 10 trees and also misplaced the heavier part of the trees and on enquiry, he failed to give satisfactory explanation.

Submission of learned counsel for the petitioner is that entire allegation is false and concocted, which will appear

from annexure – 2 series annexed with the supplementary affidavit showing that he has deposited the amount with the forest department and he is ready to abide by any condition imposed on him for grant of anticipatory bail.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -X, Siwan, in connection with Siswan P.S. Case No. 18/2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
