The petitioners seek bail in a case registered under Sections 30/38/41 of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, in short, is that 1969.920 liters wine is recovered.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.01.2019 and 6.2.2019 respectively and petitioner Chhote Kumar Rai @ Chhote Kumar Ray has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that 1969.920 liters wine is recovered from two vehicles. None of vehicles in question belongs to the petitioners. There is no compliance of Section 100 Cr.P.C.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Saran at Chapra in connection with Rasulpur P.S. case No.11 of 2019.
