3 12-06-2019 Heard learned counsel for the petitioner as well as learned APP.

Projecting themselves to be representative of reputed company, indulged in alluring the customers that in a draw they have succeeded in getting car, motorcycle etc. and on that very pretext, procure money from the customers by a gang which, having been informed to the informant let raid and during course thereof, three persons namely Santosh Kumar, Ballam Prasad and Shambhu Prasad were apprehended while rest succeeded in their escape. On search, from their possession apart from mobile set. chit a papers have also been recovered containing names of the customers. On interrogation they have disclosed identity of their associate wherein petitioner also stood.

Gone through the case diary wherefrom, it is evident that nothing has been collected by the I.O. Even, the customers

whose name have been found during course of search and seizure from the possession of apprehended accused been contacted to verify whether any kind of allurement has been made on behalf of petitioner and others. Furthermore, from para-92 petitioner has got no criminal antecedent.

In the aforesaid facts and circumstances of the case, petitioner Mithlesh Kumar is directed to be released on bail in the event of his arrest /surrender before the learned lower court within fortnight on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Shekhopur Sarai P.S. Case No.4/2018 in terms of condition as laid down under Section 438(2) Cr.P.C
