Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Akbarpur P.S. Case No. 187 of 2018 for the offences under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 03.01.2019. He further submits that in the instant case 80 liters liquor was seized but nothing was recovered from the conscious possession of the petitioner and his named surfaced on confessional statement of co-accused namely Manoj Yadav.

Learned counsel appearing on behalf of the State submits that petitioner was earlier made accused on similar such cases and as such he does not deserve bail.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional District Judge, 2^nd -cum-Special Judge, Nawada in connection with Akbarpur P.S. Case No. 187 of 2018 with condition that one of the bailors should be the elected representative of local body.
