Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 365 and 379/34 of the Indian Penal Code.

The informant had given his motorcycle to one Shivram Ram. Allegation is that Shivram Ram was abducted by the petitioner and others along with the motorcycle. The motorcycle was found at the house of this petitioner and Shivram Ram was also there.

Submission is that there was some dispute arising out of non-refund of money by Shivram Ram to the informant and just to pressurize, false case has been lodged. Petitioner has stated on oath that he has got no criminal antecedent. Some other co-accused have been allowed bail by a Coordinate Bench

of this Court vide order dated 16.04.2019 passed in Cr. Misc. No. 15282 of 2019.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jai Nagar Police Station Case No. 585 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
