The present contempt petition has been preferred by the petitioner herein to initiate appropriate proceeding under the Contempt of Courts Act for non-compliance of the order passed by the Division Bench of this Court on 15.01.2015 passed in C.W.J.C. No. 13833 of 2014.

A counter to the show cause has been filed by the Executive Engineer, P.H. Division, Sasaram, in which a detailed

counter is filed pointing out the steps taken to supply the water/drinking water.

It appears that the project is a very big project which is likely to take some more time. From the counter to the show cause, it cannot be said that there is any wilful and/or deliberate disobedience of the order passed by the Division Bench of this Court for which the contempt proceedings are required to be initiated.

Under the circumstances, we close the present proceedings, as we do not propose to initiate any proceedings against the respondents for non-compliance of the order passed by the Division Bench, as alleged.

However, all efforts shall be made to complete the scheme for supply of drinking water and appropriate authority to see that the same is completed at the earliest.
