Heard learned counsel for the petitioner, learned counsel appearing on behalf of the State and learned counsel appearing on behalf of the Accountant General, Bihar, Patna.
The petitioner had earlier moved this Court for retiral
benefits in CWJC No. 6450 of 2011 which was disposed of on 26.09.2014 with a direction to the authorities to pay full and final payment of all the retiral benefits of the petitioner.
Consequent thereto, the respondent authority have made payment but yet again the petitioner has moved this Court

for payment of General Provident Fund deducted up to 1980-81 with statutory as well as penal interest , although the same has been paid at old rate and delayed payment over due amount of salary, which has beenpaid after much delay.
From the counter affidavit, it appears that G.P.F. for the period till 1981 has been calculated amounting to Rs. 2140 and together with interest, final payment has been made of Rs. 36577/- on 10.06.2015 and due salary has also been paid to the petitioner.
Considering the nature of prayer and the nature of claim made in the petition, let the petitioner file a fresh representation regarding interest on delayed payment of salary before the Respondent No. 6, which will be disposed of by the respondent No. 6, the Block Development Officer, Fatehpur District, Gaya within a period of three months. If any amount dues as shown by the petitioner, is not admissible, the Respondent No. 6 would pass a speaking order and communicate the same to the petitioner by registered post.
