Heard learned counsel for the petitioner as well as

learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 384/386 of the Indian Penal Code .

Petitioner is not named in the first information report but his name surfaced in this case in confessional statement of co-accused Saroj Kumar, who disclosed that the petitioner was also a member of gang of Piro. It appears from perusal of the impugned order that except the aforesaid material, there is nothing against the petitioner. Moreover, Para-3 of the petition goes to show that petitioner does not have any criminal antecedent and one co-accused namely, Anshu Kumar @ Anshu

Tiwari @ Anshu Baba having, more or less similar allegation has already been admitted to anticipatory bail by a co-ordinate Bench of this Court vide order dated 17.12.2018 passed in Cr. Misc. No. 71197 of 2018

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate -I Bhojpur, Ara in Piro P.S. Case No. 285 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
