The petitioners seek bail in Motihari Rail P.S. case No. 27 of 2018 registered under Section 401 and 414 of the Indian

The informant alleged that during the course of regular checking and keeping watch on the railway thieves one Shanti Devi was apprehended and on her disclosure Krishna Devi, petitioner No.1, and Chandani Kumari, petitioner No.2, were also apprehended. From the possession of Krishna Devi Indian currency as well as currency of Nepal, U.S., U.A.E. and other countries were recovered. From the possession of Chandani Kumari ornaments of gold and silver were recovered.

The learned counsel for the petitioners submits that nobody has come forward to claim the ornaments. The petitioners are beggars. The petitioners are in custody since 05.05.2018 and they have got no criminal antecedent. Shanti Devi has already been granted bail.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that petitioners are ladies who have remained in jail for five months, the petitioners, above named, are directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Bettiah (West Champaran) in connection with Motihari Rail P.S. case No. 27 of 2018, subject to condition that one of the bailers shall be local having substantial property situated within the district of West Champaran, Bettiah.
