Petitioners are apprehending arrest in connection with Chhabilapur P.S. Case No. 17 of 2018 for the offence under sections 420 and 409 of the Indian Penal Code.
Referring to the allegation levelled against the petitioners, learned counsel appearing on behalf of the petitioners would submit that allegation in the instant case is deficiency in completion of construction work in relation to “Mukhyamantri Seven Nischay Yojana” finding irregularity at the instance of the District Magistrate, FIR has been lodged.

Considering the fact that allegation against the petitioner is deficiency in the process of construction, the team of senior engineers were involved in order to maintain quality control and payment was made only after measurement entered in the measurement book.
Considering the totality of the facts situation and also the fact that the petitioners have received payment which is less than what was entered in the measurement book, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Nalanda, Biharsharif, in connection with Chhabilapur P.S. Case No. 17 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C.
