Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in Rivilganj P. S. Case No. 16 of 2018 instituted for the offence under Section(s) 399, 402 and 414 Indian Penal Code.
In the written report it is alleged that on the date of occurrence police received information that some criminals are making plan to commit occurrence in the khatal (cattle shed) of the co accused Umesh Kumar Yadav and thereafter the police reached at the place of occurrence. The criminals assembled there started fleeing away on seeing the police party. The 11 miscreants including the petitioner were apprehended by the

police on chase. It is further alleged that one loaded country made pistol with five live cartridges were recovered from the possession of this petitioner.
Learned counsel for the petitioner has submitted that separate case has been filed under the Arms act for recovery of the fire arms. The petitioner has already been granted bail by co-ordinate Bench of this Court by order dated 3.8.2018 passed in Cr. Misc. no. 47582 of 2018 in that case. The Instant case has been filed for the offence under Sections 399, 402 and 414 of the IPC.
Petitioner is in custody since 18.1.2018
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VIII, Saran at Chapra, in connection with Rivilganj P. S. Case No. 16 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
