The petitioner seeks bail in connection with Bodh Gaya P.S. Case No. 401 of 2017 dated 24.06.2017 instituted for the offences under Sections 147, 148, 149, 447, 341, 323, 326, 307, 379, 427 and 506 of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant by Garasa, a heavy sharp cutting weapon, leading to injuries on his person. Other accused persons are said to have assaulted one Shiv Yadav leading to injuries on his person as well.

Learned counsel for the petitioner has submitted that

the injuries suffered by the aforesaid Mritunjay Yadav (informant) are simple in nature and that the petitioner has been falsely implicated in this case because of enmity between the parties.

The petitioner is in custody since 03.07.2017.

It has further been submitted that because of inadvertence, in paragraph no. 3, reference of only one case has been made whereas the petitioner, earlier, was made accused in two cases and in both of them, he is on bail.

For the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 401 of 2017.
