The petitioner, who is in custody, seeks bail in connection with NDPS Case No.79 of 2017 registered for the offence punishable under Sections 20(b) (ii) (c), 22 and 23 of the NDPS Act.

Informant is the Police Officer, who in his written complaint has stated that on 15.10.2017 at about 9:15 A.M. when he was on patrolling duty along with other police personnel received an information that two motorcycle riders carrying Ganja were going towards Ahirwaliya from village Birta Tola. Thereafter he informed to his Superior Police officer and proceeded. When the informant reached near Harijan Toli, on

seeing the police jeep two riders on a motorcycle started fleeing away but they were apprehended. Thereafter they disclosed their names as Makeshwar Sah (petitioner) and Rakesh Kumar. On search two bundles of Ganja weighing 10 kg and 11 kg in total 21 kg were recovered from the possession of the petitioner and co-accused Rakesh kumar.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that he has no criminal antecedent and one similarly situated person has already been granted regular bail by this Hon’ble Court as contained in Annexure-2 and he is in custody since 16.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with NDPS Case No.79 of 2017.
