The petitioners seeks bail in Kutumba P.S. Case No. 31 of 2015 registered for the offence punishable under Sections 395 and 398 of the Indian Penal Code.

Allegation against the petitioners is of attempting to committ dacoity.

It has been submitted that the name of the petitioner has surfaced on the basis of confession of co-accused Dinesh Chaudhary. It has been submitted that during investigation no incriminating material has come against the petitioners. It has further been submitted that similarly situated co-accused persons have been granted bail

by a co-ordinate bench of this Court vide orders dated 30.08.2016 in Criminal Miscellaneous No. 36467 of 2016 and 01.04.2016 in Criminal Miscellaneous No. 5764 of 2016. Petitioners are in custody since 15.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 31 of 2015 .
