2 10-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 19.04.2018 on his remand in connection with Sherghatti (Dobhi) P.S. Case No. 147 of 2018 for the offence registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the first information report but subsequently, on the basis of the confessional statement made before the police by the co-accused persons petitioner’s name has surfaced, which has no evidentiary value. It is further submitted neither any recovery from the conscious possession of the petitioner has been made nor he has been placed on T.I. Parade.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 147 of 2018.
