The petitioner seeks pre-arrest bail in connection with Begusarai Muffasil P.S. Case No.597 of 2017 registered under Sections 341, 323, 307, 504 and 506 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that from the allegations made in the first information report ingredients of the offence punishable under Section 307 of the Indian Penal Code are not attracted. The informant Ram Prakash Sah sustained only simple and superficial injury caused by hard and blunt substance and the same at best would be a case under Section 323 of the Indian Penal Code. Having regard to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No.597 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
