Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners, who are in custody, seek bail in connection with Aurangabad (M) P.S. Case No. 7 of 2018 registered for the offence punishable under Sections 457, 380 of the Indian Penal Code.

Informant in his written complaint addressed to Officer-in-Charge has stated that on 08.01.2018 at about 3.00 AM morning after breaking the grill, thieves entered his house and took away box, 10 saries and Rs. 5000/- cash and thereafter entered into the grocery shop and took away cash money. Meanwhile villagers saw them committing

theft and apprehended two thieves and remaining managed to flee away.

It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case. No incriminating articles has been recovered from their possession. They have no criminal antecedent and they are in custody since 08.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand)each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Aurangabad (M) P.S. Case No. 7 of 2018.
