3 29-01-2018 Heard learned counsels for the petitioners and the State.

The petitioners, already in custody, seek bail in connection with Bithan P.S.Case No. 142 of 2017 registered under Sections 272, 273 of the Indian penal Code and Section 30(a)(d) of Bihar Prohibition and Excise Act, 2016.

Submission is that several persons were apprehended and the petitioners were also there due to curiosity and so-called country made distillery is not of the petitioners and they are in custody since 20.08.2017 having no criminal antecedents.

Having considered the aforesaid facts and circumstances, the petitioners, namely, Jay Kishun Sahani and Uday Sahani are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ADJ-VI-cum-Special Judge, Bihar
