Petitioners, already in custody, seek bail in connection with Harsidhi P. S. Case No. 451 of 2017, registered under Sections 30 (a), 33 and 36 of the Bihar Prohibition and Excise Act, 2016.

The allegation in brief is that the petitioner No. 1 in his cattle shed running distillery for preparing pouch of illegal country made liquor from spirit and accordingly, five liters spirit and 48 liters of country made liquor was recovered.

Learned counsel for the petitioners submits that the petitioners are made accused in this case, but they are not concerned with that occurrence and all petitioners are in custody since 19.11.2017. It is submitted that the petitioners have no criminal antecedents.

Having considered the said facts and circumstances, the petitioners, Pannalal Prasad Kushwaha @ Pannalal Prasad Kushwaha, Munna Kumar, Jawaher Sahni and Balli Sahani @ Wali Sahani are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran in connection with Harsidhi P. S. Case No. 451 of 2017.
