Heard learned counsel for the petitioners and the
learned APP for the State.
Petitioners, already in custody, seek bail in connection with Bagaha PS Case No.99 of 2018, registered under Sections 147, 148, 149, 323, 332, 342, 337, 353, 427 and 504 of the Indian Penal Code.
Allegation in brief is that when the reached to make enquiry on the petition of one Pitambar Singh then hundreds of people assembled there and they were throwing brick-bat causing injury to Pitambar Singh and his brother and also mishandled the police personnel.
Learned counsel for the petitioners submits that the petitioners’ side had lodged a case under 436 and other sections

against Pitambar Singh, on account of the said occurrence committed by Pitambar Singh large number of villagers had turned up and protested, in the meanwhile, police came and they raised their protest for apprehending the accused and on account of that the petitioners have falsely been implicated, however, there is no injury to any police personnel.
Having considered the aforesaid facts and circumstances, petitioners, namely, Lopichand Gaur and Binod Gaur are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Bagaha, District West Champaran in connection with Bagaha PS Case No.99 of 2018.
