Petitioners, already in custody, seek bail in connection with Aurangabad (Town) PS Case No.95 of 2018, registered under Sections 147, 148, 149, 337, 323, 324, 435, 436, 427,

307, 332, 333, 353, 360, 295(A), 188 and 120(B)of the Indian Penal Code as well as under Sections 27 of the Arms Act.

Allegation in brief is that on account of procession of Ramnavami, the members of both communities pelted stones to each other and engaged in arson and assault.

Learned counsel for the petitioners submit that there are 89 named and 100 unknown accused persons and no specific overt act is alleged against the petitioners, moreover no injury was caused to anyone.

However, considering the aforesaid facts and circumstances, petitioners, namely, Saddam Hussain and Abhimanu Kumar @ Abhimanyu Kumar are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad (Town) PS Case No.95 of 2018.
