Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners, who are in custody, seek bail in connection with Dhanarua P.S. Case No. 499 of 2015 registered for the offences punishable under Section 395 of the Indian Penal Code.

Allegation is of road dacoity against five unknown criminals after looting article from the possession of informant and others. FIR is against unknown. The name of petitioners have transpired in this case on the basis of confessional statement made by one co-accused and except this confessional statement there is no incriminating material against the petitioners. Nothing have been recovered from the possession of

the petitioners. Petitioners are in custody since 22.12.2016.

Considering the aforesaid fact and circumstances of

the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Masaurhi in connection with Dhanarua P.S. Case No. 499 of 2015 with following conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) The petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be sufficient to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
