Heard learned counsel for the petitioners and learned counsel for the State.

The present application has been filed for modification of the order dated 4.4.2018 passed in Cr.Misc.No. 18490 of 2018, by which the petitioners were granted regular bail in connection with Muffasil P.S. case No.55 of 2018, pending in the court of 4^th Additional Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran.

It is submitted on behalf of the counsel for the petitioners that due to inadvertence the counsel for the petitioners while arguing the case has submitted that charge sheet has already been submitted, but later on, on 18.04.2018 the charge sheet was

submitted in the present case which is Annexure-2 to the present application.

The order dated 4.4.2018 passed in Cr.Misc.No. 18490 of 2018, is modified to the extent that on the date when the order was passed in Cr.Misc.No.18490 of 2018 the charge sheet was not submitted.

The modification application is, accordingly, allowed.
