The petitioner apprehends his arrest in connection with Dumra P.S. Case No. 02 of 2018 registered for the offences punishable under Sections-354, 354(B), 354(D)/34 of the Indian Penal Code and Section-12 of the POCSO Act.

Allegation against the petitioner is of misbehaving with the daughter of the informant. The petitioner was giving mobile to her and when she refused, he chased her to the house.

Submission of learned counsel for the petitioner is that the specific allegation is against Rahul Kumar and he was apprehended also. It has also been submitted that now the matter has been settled between the parties, which will appear from Annexure-2.

Having heard both sides and in the facts and circumstances, let the petitioner, be released on bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, (POCSO Act), Sitamarhi in connection with Dumra P.S. Case No. 02 of 2018, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
