The petitioner seeks bail in a case instituted for the offences under Section-273 IPC and Section-30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that 18.15 liters wine is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15-01-2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 18.15 liters wine is recovered. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3^rd Additional Sessions Judge-cum-Special Judge, Excise, Purnea in connection with Baisi P.S. Case No. 15 of 2018 giving rise to Special Excise Case No. 49 of 2018.
