The petitioner seeks bail in a case instituted for the offences under Sections-498A, 304(B), 201/34 of the Indian Penal Code.

Prosecution case, in short, is that the deceased/victim was killed by accused persons including the petitioner due to nonfulfillment of dowry demand.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23-08-2017 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. The petitioner is husband of the victim.

From perusal of the statements of witnesses made in paras-6, 7 & 16 of the case diary, it is apparent that the deceased died due to accidental death. No offence u/S 304(B) is made out in the light of statements of the witnesses made in the case diary.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. (Rail), Bhojpur at Ara in connection with Ara Rail P.S. Case No. 60 of 2017.
