The sole petitioner, who is in custody since 28-08-2017 in Wazirganj P.S. Case No. 479 of 2016 G.R. No. 6913 of 2016 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that since petitioner was earlier made accused in cases relating to provision of Excise Act, he has falsely been implicated in the present case. By way of referring to F.I.R., he submits that F.I.R. categorically discloses that one motorcycle was intercepted by the police, which was being driven by one

Birendra Prasad and from that motorcycle, 8 liters of countrymade mahua liquor was shown to be recovered and petitioner was made accused on the disclosure made by some of the villagers that the pillion rider of the motorcyle, who fled away, was petitioner.

Considering the nature of accusation and period of custody as well as the fact that petitioner’s name has come on the basis of disclosure made by some of the villagers and he was not apprehended at the place of occurrence, let the petitioner namely Sudhir Yadav @ Sudhir @ Sudhir Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Wazirganj P.S. Case No. 479 of 2016, G.R. No. 6913 of 2016.
