03 10-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
On 22.07.2017, written report was filed by Bhagya Narayan Jha disclosing therein that in the evening of 21.07.2017, all the accused persons, so named therein, came at his house and directed him to remove his house as, happens to be over their land. On protest, they assaulted with lathi. During midst thereof, Raushan Jha sprinkled petrol in his house and Photo Jha lit fire as a result of which, his residential house gutted. Para-5 is the P.O. wherein I.O. had incorporated that P.O. happens to be courtyard of house of informant. He had not found remnants of burnt house.
That being so, petitioner, Photo Jha is directed to be
