2 21-08-2017 Heard the learned counsel for the petitioner and APP for the State.

The petitioner seeks bail in connection with Barun P.S. Case no. 213 of 2014 registered under Section 392 of the Indian Penal Code.

Four miscreants are said to have looted Rs. 1,20,000/from the cash counter of Broad & Company at Keshav Sand Ghat on the point of pistol and one of the accused namely Vikash Kumar has sustained bullet injury in the occurrence.

It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. There is no cogent evidence

against the petitioner barring the confessional statement of coaccused Rahul Kumar and Vikash Kumar and the said Rahul Kumar and Vikash Kumar have been enlarged on bail by a coordinate Bench of this Court vide order dated 13.05.2015 passed in Cr. Misc. no. 17566 of 2015. The petitioner has been languishing in custody since 17.06.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M. Aurangabad in connection with Barun P.S. Case no. 213 of 2014.
