The petitioner seeks bail in connection with Kesaria P.S. Case no. 71 of 2017 registered under Sections 341, 323, 324, 325, 307, 379, 354, 504 and 506/34 of the Indian Penal Code.
The petitioner is said to have assaulted on the head of the informant by means of farsa inflicting bone deep incised injury over row of dumping cow dung.
It is submitted by the learned counsel for the petitioner that there is a land dispute between the parties and there is also case and counter case between them. Though the petitioner is said to have assaulted on the head of the informant by means of farsa,

but the magnitude of injury rules out inflicting of aforesaid injury by means of farsa. The petitioner has been languishing in custody since 18.06.2017.
Considering the facts and circumstances of the case, let above named petitioner, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kesaria P.S. Case no. 71 of 2017.
