2 11-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mahila P.S. Case No. 76 of 2016 instituted for the offence under Sections 376, 511, 354, 354(D)II, 504 and 506 of the Indian Penal Code.

There is allegation in the written report that the informant is newly recruited lady constable posted at police centre, Hajipur. On 30.10.2016, she was deputed in Tisiauta Police Station with other fifty ladies and male constables. The informant was unwell due to which she remained sleeping and could not attend her duty. The Sergent Majour called for explanation from the informant and when she went to give explanation, then the petitioner who is second Munshi in the Police Line, made demand of Rs.7,000/- and also touched her

private parts of her body and told indecent words to her.

Learned counsel for the petitioner has submitted that vide Annexure-2, explanation from the informant was called for by the Superintendent of Police, Vaishali, for not joining duty and also misbehaving and disobeying the order of the higher official. In counter blast to the aforesaid explanation, the instant case has been filed by the informant. The petitioner is said to be in custody since 21.4.2017.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahila P.S. Case No. 76 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
